3.1 The usual working week at the TERMINAL – 5 working days from Monday to Friday inclusive.
Official working hours:
- From 08:00 to 19:30 (except for work listed in clause 3.0.),
- Lunch break: from 12:00 to 13:00.
3.2 The services of the TERMINAL in the above-mentioned period shall be charged at the ordinary rate. Work may, on the basis of special application or special agreements, be ordered on weekends (or holidays) or in evening and night shifts, except for New Year’s, i.e. the period from 20:00 on 31 December to 17:00 on 01 January.
Payment for work done during evening and night shifts shall, unless otherwise provided for in valid agreements and understandings, be compensated on the basis of raised coefficients of base rates:
- Evening shift from 20:00 to 24:00 +25%;
- Night shift from 00:00 to 08:00 +50%;
- Work on weekends and holidays +100%.
3.3. On days (falling on either Monday or Friday) preceding holidays, the duration of the working day shall decrease by 1 hour.
3.4. The processing of ships shall take place in accordance with the schedule for the provision of the tonnage co-ordinated between carriers and the TERMINAL.
In the event that a ship is late for processing, if upon the arrival of a ship there is less time than required for the processing of the ship until the end of the shift and there is no subsequent shift at the TERMINAL (its presence is not provided for in the ships timetable) the TERMINAL shall perform the partial processing of the ship and continue in the next shift provided for in the ships timetable.
3.5. Holidays are defined as Saturday and Sunday, and also the following holidays:
- 01 January - New Year’s Day
- 24 February - Independence Day, Anniversary of the Republic of Estonia
- Good Friday
- Easter Sunday
- 1 May - May Day
- Whitsunday
- 23 June - Victory Day
- 24 June - Midsummer Day or St.John's Day
- August 20 - Day of Restoration of Independence
- December 24 - Christmas Eve
- 25 December - First Christmas holiday
- 26 December - Second Christmas holiday
3.6. All work connected with the receipt/issue of cargo that moves under its own power and/or if means of transport have been allocated to the ship for the further transportation of these cargoes (direct option), shall be performed 24 hours per day at times specified in the valid schedule. Excise cargoes the issuing of which may be suspended until the beginning of the official working day or by order of state bodies (customs, border guard) may form an exception.
3.7. Work connected with the formation and disassembly of expanded cargo areas and the processing of land transport devices generally takes place from 08:30 to 16:30 on working weekdays, unless otherwise provided for in corresponding agreements.
3.8. The following breaks in work during the processing of means of transport have been established:
- From 05:00 to 05:15
- From 07:45 to 08:15
- From 17:00 to 17:15
- From 19:45 to 20:15,
but also lunch breaks:
- From 12:00 to 12:45 and
- From 00:00 to 00:45.
3.9. Such tasks as the issuing of cargoes of containers, trailers, cars, etc. are generally be performed from 08:30 to 16:30 and only on working weekdays, unless connected with the processing of the ship under the direct option, but also if issue of the cargo requires transhipment operations or if there is an order from state bodies for the detention of the cargo.
3.10. The Client may make advance written application for the issue of cargo after official working hours, as well as on weekends and holidays. The issuing of cargo shall take place after the completion of customs formalities and only after receipt of confirmation from the TERMINAL of the completion of such work.
3.11. In receiving excise cargoes, the Client is required to present to the TERMINAL an export permit from the customs bodies, order a convoy and also perform all of the other requirements of state bodies.
The TERMINAL does not bear responsibility for the Client’s provision of false information or failure to present information concerning cargo.
3.12. The receipt of cargoes shall take place in the case of cargoes that do not required transhipment and/or whose receipt is not connected with means of land transport, the processing of means of transport under own power for cargoes, as well as trailers brought to the TERMINAL with the Client’s own funds – 24 hours (except for on New Year’s, from 20:00 on 31 December to 17:00 on 1 January); in the case of cargoes that required transhipment and the processing of means of land transport – in official working hours, unless otherwise provided for in corresponding agreements.
3.13. To submit the cargo to the TERMINAL, the Client is required to present the following with the cargo:
- Cargo ticket or carrier’s bill of lading, if the cargo is subsequently to be transported onto a ship without transhipment;
- The covering note for cargo that is to be delivered using the Client’s transport and that is to be sent to transhipment before being sent onto the ship, the formation of expanded cargo areas on the railway, platform (flat), trailer or container for loading.
3.14. In order to receive a cargo from the TERMINAL, the Client is required to present:
- Load ticket for cargoes on the "Muuga-Helsinki-Muuga" line;
- For other routes, a bill of lading;
- Authorisation for the receipt of the cargo and the Client’s representative’s personal identity document;
- A letter of guarantee concerning payment for the services of the TERMINAL or a document that confirms the fact of the pre-payment of the services of the TERMINAL.
3.15. A compulsory precondition for the receipt of cargo is the existence of an order for the issue of the cargo at the TERMINAL, which must have been presented to the TERMINAL addressed to the corresponding forwarding agent by the carrier.
3.16. The Client is required in all cases to draft all necessary permits, licences, declarations, and other such documents in accordance with current legislation and the regulations established, as well as solving questions of the entry into the TERMINAL and provision of means of land transport before the delivery of export cargo to the TERMINAL and the receipt of import cargo for the despatching of the cargo to its destination independently, without the participation of the TERMINAL.
